The Constitution of Kwedregiol:

 

Chapter 1

 

Art. 1

There comes a time when government overwhelms the choices of the individual, when there are so many people that their elected representatives cannot accurately represent them.  There comes a time when differences are silenced, pushed aside as an embarrassment, and not celebrated as they should be. There comes a time when elected officials believe themselves to be above the people, and not held to the same standards of morality, decency, and truthfulness that we all are held to. The nation of Kwedregiol is hereby formed in the spirit of peace, truthfulness, trust, and equality.  We seek to pass down a nation small enough that every individual is a valued contributor to their government, and yet large enough to ensure that it's citizens are strong, and represented to all.  

 

 

Chapter 2: the Omniscient Despot

 

Art. 2

The Omniscient Despot shall be the representative and diplomatic head of Kwedregiol. 

 

Art. 3

The Omniscient Despot shall perform the duties stated herein:

a) Call the Grand Council to meet whenever the country shall have a need to make new laws, or whenever a matter of national importance shall arise. The Omniscient Despot will call the Grand Council to meet not less than once per year.

b) Preside over the Grand Council.  The Omniscient Despot shall put to vote all matters that come before the Grand Council, and shall inform the citizens of Kwedregiol of all decisions made by the Grand Council.

c) Represent Kwedregiol to all other nations. The Omniscient Despot shall act as the spokesperson for the country, so that Kwedregiol may provide a unified viewpoint to the world.  The Omniscient Despot shall seek to provide accurate representation for all Enclaves, as well as for all of Kwedregiol as a whole.

 

Art. 4

 The Omniscient Despot shall be elected for a term of five years by the population of Kwedregiol, using the secret ballot method. A majority of votes elects a candidate into office.

 

Art. 5

The Omniscient Despot must be a legal adult of at least 16 years of age, and must be a natural born citizen of Kwedregiol. 

 

 

Art.  6

The Omniscient Despot may not be the subject of a criminal trial while in office, and may not be evicted from office in any way until his/her five year term in office has ended.  He/She may be tried for any offenses committed while in office after his/her term has ended, and shall not be considered above the laws in any way prior to or post his/her term in office.

 

Art. 7

The Omniscient Despot shall not be deemed as criminal for acts performed in the necessary and reasonable dischargement of duties while in office.

 

Art. 8

The Omniscient Despot may not make decisions for the country without the permission of the Grand Council.

 

 

Chapter 3: The Enclaves

 

Art 9

The Nation of Kwedregiol shall be composed of Enclaves which shall look toward the Grand Council and the Omniscient Despot as an example of the ideals Kwedregiol represents, but shall govern themselves completely and independently.  

 

Art. 10

Enclaves shall be bound by the rules and tenets set forth in this constitution.

 

Art. 11

Territories of Kwedregiol wishing to become Enclaves may submit a written request stating the contributions they feel they can make to the Nation at large.  The Omniscient Despot of Kwedregiol will then put the matter to a vote among the Grand Council. A Majority of votes instates said Territory to Enclave status as soon as the newly elected Enclave presents a constitution, containing at least a plan for sending representatives to the Grand Council, the Grand Court, and a plan to defend itself, to the Grand Council.  No reasonable petition for Enclave status shall be denied.  Constitutions of the Enclaves shall not be subject to approval by the Grand Council and shall not be ratified by the Grand Council in any way, unless it is incompatible with the central constitution of Kwedregiol.

 

Art. 12

If it becomes necessary, by acts of treason or great infamy, to disestablish an Enclave, the Grand Council may vote to evict it from the nation.  Only a unanimous vote (not including the Enclave in question) can evict the Enclave from the nation. The former Enclave is still considered as part of Kwedregiol, though it is no longer allowed representation.  Any member of a disestablished Enclave may apply for Enclave status under the normal rules and regulations at any time.  

 

Art. 13

The free exchange of trade may not be limited between the Enclaves of Kwedregiol.

 

Art. 14

All Enclaves are bound by the laws set forth in this constitution, and they agree to abide by said laws in submitting a petition for Enclaveship.

 

 

Chapter 4: The Grand Council

 

Art. 15

Each Enclave shall choose two persons to serve as the representatives of their Enclave.  Each representative must be a legal adult of at least sixteen years of age, and must be a citizen of the Enclave they represent.

 

Art. 16

The Grand Council shall perform the duties stated herein.

a) Make all decisions pertaining to the policies of the country at large.  The Omniscient Despot shall consult with the Grand Council on all matters that require a national response, and they shall decide through a majority vote what the appropriate action is.

b) Ratify the central constitution. If it is deemed necessary to change or update the laws set forth in this constitution, the Grand Council may submit a law to the Omniscient Despot so that all may vote to instate it.  The Omniscient Despot must put the matter to vote within a reasonable amount of time. Only a unanimous vote can instate the law into the constitution. 

c) Represent their Enclave to the nation of Kwedregiol.

 

Art. 17

Every measure must be taken to ensure that representatives from every Enclave are able to attend all meetings of the Grand Council.

 

 

Chapter 5: Citizens of Kwedregiol

 

Art. 18

Any persons naturalized by either the Central state of Kwedregiol, or to any of it's Enclaves is considered a citizen of Kwedregiol. Any person born on property protected by Kwedregiol, or any person born to a citizen of Kwedregiol is also considered a citizen of Kwedregiol. 

 

 

Art. 19

Citizens of Kwedregiol may hold dual citizenships with other nations.

 

Art. 20

All persons have the right to renounce citizenship, and to travel freely about the country as they will.  All persons have the right to religious and/or political asylum.

 

Art. 21

Persons wishing to become citizens of Kwedregiol must apply to a specific Enclave to gain membership, per the rules and regulations of that Enclave.  Persons wishing to become citizens of Kwedregiol may apply to more than one Enclave if citizenship is denied by a previous Enclave.  Persons deemed to be a threat to the Nation of Kwedregiol, or who have been previously convicted of treason shall be denied citizenship by all Enclaves.

 

Art. 22

Citizens of Kwedregiol may belong only to one Enclave at a time.

 

     Chapter 6: Human Rights

Art. 23

All Citizens of Kwedregiol are granted basic human rights:

a) All persons have the inherent right to life, liberty and the pursuit of happiness to the point that those pursuits do not interfere with public welfare.

b) No person will be denied the right to speak freely, or to write and publish what he/she will. 

c) No person will be denied the right to worship as he/she sees fit.

d) No person will be denied his/her human rights without due process of law.  All persons are entitled to a fair and public trial.

e) No person will be arrested without the knowledge of the crime/s they are being arrested for.  No person will be imprisoned for more than forty eight hours without sufficient evidence of their having committed a crime.

f) No person will be denied access to the courts.

g) No persons shall be held in slavery or servitude against their will.  Slave trade in any form shall be prohibited.

h) No one shall be subjected to arbitrary interference with his privacy, family, home or correspondence, nor to attacks upon his honor or reputation. Everyone has the right to the protection of the law against such interference or attacks.

i) Every person has the right to freedom of peaceful assembly and association. No person may be forced to belong to an association against his/her will.

j) Everyone, without any discrimination, has the right to equal pay for equal work.

k) Everyone has the right to education. Education shall be free in the elementary and fundamental stages, and shall be directed to the strengthening of respect for human rights and fundamental freedoms. Education shall further the activities of all Nations in the establishment and maintenance of peace.

l) In the exercise of his/her rights and freedoms, everyone shall be subject only to such limitations as are determined by law solely for the purpose of securing due respect for the rights and freedoms of others, and of meeting the just requirements of morality, public order, and the general welfare in a democratic society.

m) Men and women of age, without any limitation due to race, nationality, religion, or sexual orientation, have the right to marry and to found a family. They are entitled to equal rights as to marriage, during marriage and at its dissolution. Marriage shall be entered into only with the free and full consent of the intending spouses.

 

 

Chapter 7: Judicial

 

Art. 24

The Republic of Kwedregiol recognizes a single Grand Court, established to interpret the laws of the land.

 

Art. 25 

The Grand Court will consist of one civilian per Enclave, elected by the people of that Enclave. Each member will serve the nation for no more than 15 years.  No member of the Grand Court may be asked to step down, or be impeached in any way prior to his/her 15 year term in office, though he/she may voluntarily resign at any time.

 

Art. 26

Members of the Grand Court must be established residents of the Republic of Kwedregiol for a minimum of 10 years, and have sufficient knowledge of the laws of the land.

 

Art. 27

Members of the Grand Court can not be the subject of a criminal trial while in office.  Members of the Grand Court will not be held as criminals for matters in relation to the necessary and reasonable dischargement of the duties of their office. 

 

Art. 28

Decisions of the Grand Court are final.

 

Art. 29

The Grand Court may from time to time establish subordinate courts as is necessary.

 

 

Chapter 8: The Military

 

Art. 30

Each Enclave may form and train troops for the defense of it’s own property, and shall run it’s military as it sees fit.

 

Art. 31

Should a situation arise when a national military is necessary to defend the nation, the Grand Council may vote to turn over the command of the individual Enclave troops to the Omniscient Despot.  A majority of two-thirds grants the Omniscient Despot control over all Enclave troops for the duration of one year.  At the end of this time the command of the military automatically reverts to the individual Enclaves, unless the Grand Council votes to extend the Omniscient Despot’s control for another year.  This year may not be shortened or lengthened in any manner, for any reason.  

 

 

Chapter 9: Treason

 

Art. 32

The Republic of Kwedregiol promotes worldwide peace. Acts undertaken to prepare for war or to otherwise disturb the peaceful relations between Nations or Enclaves are considered treasonous.  Deliberate acts that seriously endanger the welfare of the Republic of Kwedregiol are also considered as treason.

 

Art. 33

Those found guilty of Treason will be divested of their citizenship, and also deprived of all rights and protections provided by the Republic of Kwedregiol.  Persons found guilty of Treason will be given sufficient time to leave the country.  If they decline to do so, or if they return to Kwedregiol after being convicted of Treason, they may be put to death.   

 

Art. 34

No citizen may be convicted of treason without the express testimony of at least two witnesses.
